Marine accused of involvement in Afghanistan suicide cops a plea, gets 30 days

A Chinese-American soldier, Harry Lew, a Kaneohe Marine from California, killed himself on April 3, 2011 in Afghanistan.

Investigators found Lew was subjected to a brutal hazing by his fellow Marines. A special court-martial was completed today on the Kaneohe Bay Marine Corp. base for Lance Cpl. Jacob D. Jacoby, one of three accused of brutally hazing Lew.

A special court-martial is reserved for lesser offenses. Jacoby and prosecutors had worked out a plea agreement under which Jacoby would plead guilty to only two of the charges he faced. When sentencing was completed this evening it was announced that:

The Special Court Martial adjourned at 19:16 (Hawaii time).

LCpl Jacoby entered pleas of guilty to all three specifications of charge 2 (assault)
Charge 1 and charge 3 were withdrawn

Results of sentencing:

* confinement for 30 days
* reduction to the pay grade of E-2 (he was an E-3)

Cole reports that the dropped charges were wrongfully abusing, humiliating and demeaning a person; and communicating a threat.
